These Terms of Use ("Terms") form a legally binding agreement between you ("User," "you") and Jatinder Gandhi Center For Career Development, a career counselling practice operated by Jatinder Singh Gandhi ("we," "us," "our"), with its principal place of operation in India.

By accessing or using www.jatindergandhi.com (the "Website"), booking any counselling session, completing any assessment, or otherwise engaging with our services, you confirm that:

• You have read, understood and accepted these Terms.
• You agree to be bound by our Privacy Policy and Refund Policy, which are incorporated into these Terms by reference.
• You have the legal capacity to enter into this agreement (or if a minor, your parent/guardian has consented on your behalf).

02Description of Services

Jatinder Gandhi Center For Career Development provides career guidance and related advisory services, which may include:

• One-on-one career counselling sessions (online via Zoom/Google Meet or in-person).
• Psychometric and aptitude assessments (MBTI, Holland Code, DMIT and others).
• Career roadmaps and written reports.
• Study abroad guidance, including university shortlisting, SOP review and scholarship support.
• Professional career change consulting for working individuals.
• Parent consultation sessions.
• Personal development services and skill-direction guidance.

Services are delivered in Hindi or English at your preference. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

03Eligibility & User Information

To book and receive our services, you must:

• Be at least 18 years of age, OR be a minor with verifiable parental/guardian consent.
• Provide accurate, current and complete information when booking sessions or completing assessments.
• Maintain and promptly update your contact details so we can deliver services.
• Be responsible for safeguarding any login credentials, links to private sessions, or assessment reports shared with you.

You agree not to impersonate any other person, misrepresent your age, qualifications, or any other information when interacting with us. We reserve the right to refuse service, terminate bookings, or cancel access if we discover any false or misleading information.

04Bookings, Payments & Refunds

Booking

• All bookings are confirmed only after successful payment via Razorpay and our written confirmation.
• Session slots are reserved exclusively for you from the moment of confirmation.
• We reserve the right to reschedule sessions due to unavoidable circumstances; in such cases, alternative dates will be offered.

Payments

• All fees are quoted in Indian Rupees (₹) and processed securely through Razorpay.
• You are responsible for any applicable taxes (such as GST) as required by Indian law.
• We do not store your card or banking credentials — these are handled directly by Razorpay's PCI-DSS compliant systems.

Refunds

All fees are non-refundable once any service has been utilized. Refund requests will not be entertained once counselling sessions, psychometric assessments, or any other services have been availed — in part or in full.

05User Conduct

When using our Website and services, you agree NOT to:

• Misrepresent your identity, age, qualifications, or the reason for seeking counselling.
• Record, screenshot, or transmit session content, assessment questions, or counsellor commentary without our explicit written consent.
• Share, resell, or redistribute reports, roadmaps, SOPs, or any deliverables provided to you, in whole or in part.
• Use abusive, threatening, discriminatory, or harassing language toward the counsellor or any staff member.
• Attempt to gain unauthorized access to our systems, server, or other users' data.
• Use our services for unlawful purposes or in violation of any applicable Indian law.
• Submit fake reviews or testimonials, or post defamatory content about Jatinder Gandhi Center For Career Development on any platform.
• Use bots, scrapers, or automated tools to harvest data from our Website.

Violation of these rules may result in immediate termination of services without refund, and we reserve the right to pursue legal remedies under applicable law.

06Nature of Counselling Services

Jatinder Gandhi Center For Career Development provides career guidance and educational counselling. Please understand:

• Our advice is based on professional expertise, psychometric data, and industry insights, but it is not a guarantee of admission, employment, salary, or any specific outcome.
• Career decisions ultimately rest with you and your family. We provide guidance to inform those decisions — we do not make them for you.
• We do not provide medical, psychiatric, psychological treatment, legal advice, or financial investment advice.
• If you are experiencing severe emotional distress, anxiety, depression, or any mental health concern, we strongly recommend consulting a qualified mental health professional.

07Intellectual Property Rights

All content, materials, frameworks, and intellectual property associated with Jatinder Gandhi Center For Career Development — including but not limited to:

• The Website design, code, layout, and graphics.
• Logos, brand names, slogans, and trademarks.
• Career assessments, methodologies, and proprietary frameworks.
• Career roadmaps, reports, written content, and templates.
• Articles, blog posts, videos, and educational materials.

...are owned by or licensed to Jatinder Gandhi Center For Career Development and are protected by Indian and international copyright, trademark, and other intellectual property laws.

Permitted Use

You may use materials provided to you solely for your personal, non-commercial career planning. You may not:

• Copy, reproduce, republish, or distribute our content without written permission.
• Use our reports or assessments to advise third parties commercially.
• Translate, adapt, modify, or create derivative works from our materials.
• Remove copyright, trademark, or attribution notices from any materials.

08Confidentiality

We treat all information you share — your goals, concerns, family context, assessment responses, and life situations — as strictly confidential. We will not disclose this information to third parties except:

• With your explicit written consent.
• To trusted service providers (assessment platforms, hosting) under their own confidentiality terms.
• If required by valid legal order or applicable Indian law.
• If we reasonably believe disclosure is necessary to prevent serious harm to you or others.

In return, we ask that you respect our confidentiality too — by not recording, sharing, or publicly disclosing the content of our private sessions or proprietary materials.

09Disclaimers

Our services are provided on an "as is" and "as available" basis. While we strive for excellence, we make no warranties — express or implied — about:

• Career outcomes: Admission to specific colleges, placement in particular companies, achievement of specific salaries, or any other defined career result.
• Website availability: Uninterrupted access, error-free operation, or compatibility with all devices/browsers.
• Third-party content: Information from external sources, assessment platform results, or links to other websites.
• Suitability: That our services will meet your specific personal expectations or requirements.

Career outcomes depend on numerous factors outside our control — including your effort, market conditions, admission criteria, employer decisions, family circumstances, and economic factors.

10Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• Jatinder Gandhi Center For Career Development, its founder Jatinder Singh Gandhi, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
• This includes (without limitation) loss of opportunity, loss of earnings, lost admission seats, missed deadlines, or emotional distress.
• Our total aggregate liability for any claim arising from our services shall not exceed the actual fees paid by you for the specific service giving rise to the claim, in the 12 months preceding the claim.
• We are not liable for any failure or delay caused by events beyond our reasonable control (force majeure), including but not limited to internet outages, illness, natural disasters, government actions, or pandemics.

11Indemnification

You agree to indemnify, defend, and hold harmless Jatinder Gandhi Center For Career Development, Jatinder Singh Gandhi, and our affiliates from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from:

• Your breach of these Terms or any applicable law.
• Your misuse of our services, reports, or materials.
• Any false, misleading, or defamatory content you post about us.
• Your violation of any third-party rights, including intellectual property or privacy rights.

12Termination

We reserve the right to suspend or terminate your access to our services, with or without prior notice, if you:

• Violate any provision of these Terms.
• Engage in abusive, threatening, or harassing behaviour.
• Provide false or misleading information.
• Attempt to misuse, redistribute, or commercially exploit our materials.
• Use our services in a manner that exposes us to legal liability or reputational harm.

Upon termination, your right to use our services ceases immediately. Fees already paid are non-refundable in cases of termination due to your breach of these Terms.

13Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, services, or applicable law. When we do:

• For material changes affecting your rights or obligations, we will provide reasonable notice via email or WhatsApp if you are an active client.
• Your continued use of our Website or services after the updated Terms take effect constitutes your acceptance of the changes.
• If you disagree with the revised Terms, your sole remedy is to stop using our services.

14Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the services shall be subject to the exclusive jurisdiction of the courts in Delhi, India.

Before initiating legal proceedings, both parties agree to attempt good-faith resolution through written communication and, where appropriate, mediation.
